These Terms govern your use of the MindCare website, assessments, and telehealth services. By using the site you agree to these Terms.

1. Who we are
MindCare is an online psychiatry practice operated by licensed clinicians, including Tyler Davis, PMHNP-BC. Telehealth services are provided only in states where our clinicians are licensed.
2. Not medical advice in emergencies
The website and assessments are for informational purposes and do not establish a patient-clinician relationship by themselves. They are not a substitute for emergency care. If you are in crisis or thinking about harming yourself, call or text 988 or go to your nearest emergency room.
3. Eligibility
You must be 18 or older and physically located in a state where we are licensed to create an account or receive care. You agree to provide accurate information.
4. Treatment, prescriptions & controlled substances
All clinical decisions, including any prescription, are made solely by a licensed clinician based on a comprehensive evaluation, your medical history, and applicable federal and state laws (including the Ryan Haight Act and DEA regulations for any controlled substance). Treatment is not guaranteed and medication may not be appropriate for every patient.
5. Fees & cancellations
Pricing for visits and membership is shown on the Pricing page. We charge a fee for appointments cancelled or rescheduled with less than 24 hours' notice. Refunds for unused services are issued at our discretion.
6. Acceptable use
Do not misuse the site (scraping, attempting to access other patients' records, uploading malicious content, impersonation, or interfering with service availability). We may suspend accounts that violate these rules.
7. Intellectual property
The MindCare name, logo, content, and software are owned by MindCare or its licensors. You may not copy or redistribute them without written permission, except for personal, non-commercial use.
8. Disclaimers & limitation of liability
The website and informational content are provided "as is" without warranties of any kind. To the maximum extent allowed by law, MindCare is not liable for indirect, incidental, or consequential damages arising from use of the website. These terms do not limit liability for professional negligence in the provision of care.
9. Governing law & changes
These Terms are governed by the laws of the state where MindCare is headquartered. We may update them; we'll change the "last updated" date above and, for material changes, notify active patients.
