HIPAA Notice of Privacy Practices

Our duties

MindCare is required by law to maintain the privacy of your protected health information (PHI), to provide you with this Notice of our legal duties and privacy practices, and to notify you in the event of a breach affecting your unsecured PHI.

Uses & disclosures we may make without your authorization

• Treatment. Sharing information among your care team and other providers involved in your care.
• Payment. Billing you, your insurer, or HSA/FSA administrator for services.
• Healthcare operations. Quality improvement, training, audits, and administration.
• As required by law. Including mandatory reporting, court orders, and public health activities.
• To prevent a serious threat. When necessary to prevent harm to you or others.

Uses that require your written authorization

Most uses of psychotherapy notes, marketing communications, and any sale of PHI require your written authorization. You may revoke an authorization at any time in writing, except where we have already acted in reliance on it.

Your rights

• Inspect and request a copy of your medical and billing records.
• Request an amendment of information you believe is inaccurate or incomplete.
• Receive an accounting of certain disclosures of your PHI.
• Request restrictions on certain uses and disclosures.
• Request confidential communications by alternative means or at alternative locations.
• Receive a paper copy of this Notice.
• File a complaint with us or with the U.S. Department of Health and Human Services without retaliation.

How to exercise your rights or file a complaint

To exercise any right above or to file a privacy complaint, send us a secure message. You may also file a complaint with the HHS Office for Civil Rights at hhs.gov/ocr.

Changes to this Notice

We reserve the right to change this Notice and to make the revised Notice effective for PHI we already have as well as any PHI we receive in the future. The current Notice will always be posted on this page.
